Over the last few years, the Office of Federal Contract Compliance Programs (OFCCP) has been increasingly active—and 2016 has offered no respite. With the implementation of new sex discrimination and pay transparency rules, blacklisting and paid sick leave obligations, a continuing emphasis on ferreting out systemic pay discrimination, and the agency’s Mega Construction Project Program, federal contractors are struggling to stay on top of burdensome laws and executive orders. The recent release of the U.S. Government Accountability Office’s report on OFCCP’s deficiencies has already created internal agency change, and contractors can now expect rigid compliance expectations and timelines.
