On September 18, 2019, Governor Gavin Newsom signed into law Assembly Bill (AB) 5, codifying last year’s Supreme Court of California decision that established a new three-factor test, known as the ABC test, to determine whether a worker is an independent contractor or an employee. In addition to codifying the ABC test, the new law contains carve outs for several industries and occupations, including professional services, doctors, lawyers, real estate, insurance, and referral agencies that will be subject to the multifactor Borello test (or similar tests) if they meet certain conditions.
