The ongoing global pandemic and the November elections ushered in a number of changes for unions, including remote organizing, novel collective bargaining conflicts, and the Protecting the Right to Organize (PRO) Act. In addition, the uncertain future of representation-case rule amendments, ongoing pandemic-related protected concerted activity, and myriad new National Labor Relations Board rulings—including a November 9, 2020, decision establishing new standards for conducting mail- and manual-ballot elections—have presented new labor challenges for employers.
