By moving from tips or gratuities to mandatory service charges, hospitality and other service establishments may be able to designate their service staff as exempt from overtime pay under Section 7(i) of the Fair Labor Standards Act (FLSA). However, the 7(i) exemption for commissioned employees can be technical and present a number of pitfalls for the unwary.
