On July 1, 2024, Governor Gavin Newsom signed two complementary bills to reform California’s Private Attorneys General Act of 2004 (PAGA). The speakers will outline how employers can take advantage of PAGA’s expanded defenses in the second installment of this two-part series. This includes how employers can proactively reduce potential exposure by implementing training and audits before receiving a PAGA notice, as well as how they can utilize the cure provisions after receiving a PAGA notice. Additionally, the speakers will discuss the courts’ authority to limit the scope of PAGA claims, the California Department of Industrial Relations’ ability to expedite hiring and fill vacancies to ensure effective and timely enforcement of employee labor claims, and the impact of the PAGA reform legislation on existing PAGA claims.
