While Executive Order 14173 eradicated affirmative action and non-discrimination requirements for covered federal contractors and subcontractors, it also created new compliance obligations for almost all recipients of federal funding. Employers doing business with the federal government or even just receiving federal funding now must comply with these new non-discrimination requirements and certify that they do not promote any diversity, equity, and inclusion (DEI) programs that violate applicable federal anti-discrimination laws.
