On November 8, 2022, voters in Missouri overwhelmingly approved a ballot measure to legalize recreational marijuana, and to amend the existing medical marijuana law to include express employment protections. Specifically, Missouri’s medical marijuana law now prohibits employers from discriminating based on (1) an employee’s status as a qualifying patient or primary caregiver who has a valid identification card or (2) a positive drug test for marijuana components or metabolites of a person who has a valid qualifying patient identification card (with certain exceptions).
