DHS’s Proposed Fee Menu: What’s Next for H-1B Quota (Cap) Cases?

The U.S. Department of Homeland Security (DHS) has proposed a new rule requiring a fee of $103,265 for all cap-subject H-1B petitions starting in calendar year 2027, including those subject to the advanced-degree cap/quota. According to the proposal, the fee would need to be paid at the time of filing cap-subject H-1B petitions, in addition to existing fees, to help cover the administrative costs of the federal immigration system.
