Many employees are unaware or forget that federal and state anti-harassment and discrimination laws (including Title VII of the Civil Rights Act, the Americans with Disabilities Act, and the Age Discrimination in Employment Act) apply to interactions outside of the physical office or facility—particularly in times of quarantine or stay-at-home mandates. In fact, the increase in electronic communications has led to a corresponding uptick in online bullying, harassment, and other hostile behavior, all of which may violate the same laws that employers must enforce when employees are in the office. Further, the work from home setting has not changed the fact that employee complaints must be investigated—now, using electronic means of communication rather than in-person interviews.
