As the country reopens and companies resume operations, employers are likely to face difficult questions regarding “high-risk” employees as defined by the U.S. Centers for Disease Control and Prevention and state and local governments. Some high-risk employees may refuse to return to the office for fear of COVID-19 exposure. Similarly, employers may be concerned about returning high-risk employees to work even if they want to return.
