In December 2020, the U.S. Equal Employment Opportunity Commission (EEOC) revised its guidance addressing employer COVID-19 vaccination programs and confirmed that federal laws do not prevent employers from encouraging or mandating the vaccination of their employees. And, just last week, the EEOC proposed wellness program rules that may result in final regulations impacting an employer’s ability to incentivize vaccinations. Many questions remain, however, regarding how and when employers should assemble the pieces to the complex puzzle of what is the correct approach and timing for their organization and workforce.
