Proposed Rule to Modernize H-1B Requirements and Revamp the H-1B Cap Registration Process

On October 23, 2023, the Department of Homeland Security published a notice of proposed rulemaking (NPRM) in the Federal Register entitled, “Modernizing H-1B Requirements, Providing Flexibility in the F-1 Program, and Program Improvements Affecting Other Nonimmigrant Workers.” The proposed rule seeks to update regulations governing the H-1B visa program, including provisions designed to revamp the H-1B cap registration process and ensure the integrity of the program.
