New Executive Order Challenging State AI Laws: How Will Employers Be Impacted?

On December 11, 2025, President Donald Trump issued an executive order (EO) aimed at promoting the United States’ artificial intelligence (AI) “supremacy.” Among other elements, this EO directs the attorney general to establish an “AI Litigation Task Force” to challenge state AI laws on constitutional and preemption grounds. While existing AI laws in jurisdictions like California and New York City—and new laws coming into effect in 2026 in Illinois, Texas, and Colorado—will remain in force unless a court or local jurisdiction directs otherwise, the EO’s impact is uncertain and may lead to litigation.
