Many employers have voluntary self-identification programs that request applicants and employees to share their demographic data. However, the collection of workforce data is facing increased scrutiny due to recent executive orders and agency guidance addressing “illegal” diversity, equity, and inclusion programs, including the U.S. Equal Employment Opportunity Commission’s recent technical assistance documents. With the rescission of Executive Order 11246, federal contractors are no longer required to collect race/ethnicity and sex data from applicants. As a result, they may need or want to reassess their self-identification programs.
