DEI enforcement across the whole of government is no longer a forecast but a reality. In 2026, the EEOC made DEI-related discrimination its top enforcement priority, DOJ secured multimillion-dollar False Claims Act settlements from federal contractors, and plaintiffs’ firms and whistleblower groups began building cases based on employers’ own public statements. The Supreme Court has also agreed to hear a school admissions case that could affect how courts treat facially neutral policies challenged as intentional discrimination, which aligns with the intent-based theory the EEOC is now prioritizing against employer DEI programs. In this webinar, the speakers will outline where agency and private-plaintiff activity is likely headed in 2027, which practices carry the most risk, and what employers should do in the first quarter.
